Expert Witness Reports
Independent expert witness reports for building and construction disputes in Melbourne. Comprehensive, evidence-based assessments.
Expert Witness Reports for Construction Disputes in Melbourne
When a construction dispute escalates beyond a simple conversation with your builder, you need independent, professional evidence. An expert witness report from IOA provides exactly that — a thorough, unbiased assessment of the building work in question, prepared by an experienced building consultant who understands both the technical requirements and the legal standards your report needs to meet.
Whether your report is for negotiation with your builder, submission to DBDRV, presentation at VCAT, or support of an insurance claim — we prepare it to the highest standard. Our principal consultant Anton Molnar is a BPC-registered building practitioner (CB-L 16678) and Master Builder with decades of hands-on industry experience.
What does an expert witness report include?
Our expert witness reports are comprehensive documents designed to provide clear, defensible evidence for building and construction disputes.
Detailed defect identification
Every defect is individually identified, described, and photographed. Each issue is documented with precision, including its location, nature, severity, and the specific way it deviates from acceptable building practice.
Building code and standards references
Each defect is assessed against the applicable building codes, standards, and regulations including the Building Code of Australia (BCA/NCC), relevant Australian Standards (AS 2870 for footings, AS 3740 for waterproofing, AS 1684 for timber framing), the conditions of the building permit, and the approved plans.
Estimated rectification costs
For every defect identified, we provide an estimated cost to properly rectify the issue based on current market rates and our extensive experience.
Photographic evidence
All defects are thoroughly documented with photographs that clearly illustrate the issue, context, and any evidence of cause.
Expert declaration
For VCAT proceedings, our reports include the expert declaration required under Practice Note VCAT 2 (PNVCAT2).
Types of construction disputes we report on
Our reports cover the full spectrum of residential building disputes:
New build defects
Issues discovered during construction or after handover. We inspect at any stage — slab, frame, lockup, fixing, or practical completion. Learn more about our new construction inspection services.
Renovation and extension disputes
Renovation projects are particularly prone to disputes because they involve the interface between existing construction and new work. A dilapidation inspection before work begins can provide critical baseline evidence if a dispute arises later.
Waterproofing failures
Waterproofing defects in bathrooms, balconies, decks, and basements are among the most common and most damaging building defects. We identify the point of failure, assess compliance with AS 3740, and estimate the full cost of rectification.
Structural defects
Foundation movement, cracking, inadequate footings, non-compliant framing, roof truss problems, and retaining wall failures.
Builder insolvency claims
When a builder goes into liquidation, homeowners need a detailed report documenting the state of the incomplete work, identifying defects, and estimating the cost to complete and rectify — essential for domestic building insurance claims through the VMIA.
Owner builder inspections and 137B reports
If you’re an owner builder, you may need a 137B report for the sale of your property or a compliance inspection. We provide these as part of our broader inspection services.
Insurance claim support
If your insurer has declined or underpaid a building defect claim, our independent report provides the evidence to challenge that decision.

EXCELLENT 67 reviewsPosted on Google Mary Walker5. September, 2021.Trustindex verifies that the original source of the review is Google. I was so fortunate to find out about Anton. If you happen upon these reviews or hear about him don't delay in using his services as a building inspector. Anton will always tell you the truth and there is nothing better than that. He inspected houses for me prior to sale and his inspections were thorough and detailed. Through his feedback it also helped me determine what I would and wouldn't put up with in regards to repairs and quality. I have chosen a brilliant house because of him and I'm so thankful for all his advice.Posted on Google Lisa21. May, 2021.Trustindex verifies that the original source of the review is Google. We were so glad that we had Anton from IOA Building Inspections report on a property we were going to buy. Thanks to Anton and his expertise and professionalism we were saved from purchasing a house with major defects. When we found another property we didn’t hesitate to call Anton again. We wouldn’t buy without calling him first, he’s thorough, prompt and very knowledgeable. Lesson learnt-for a small cost now you could save yourself a lot of heartache and money later.Posted on Google Dan H19.
