What is a VCAT expert witness report?

A VCAT expert witness report is a formal, independent assessment of building work prepared by a qualified building consultant. Unlike a standard building inspection, an expert witness report must meet specific legal requirements set out in Practice Note VCAT 2 (PNVCAT2).

Your report must include:

  • An independent, unbiased assessment of the building work in question
  • Identification of each defect or area of non-compliance with the relevant Australian Standards, the Building Code of Australia (BCA/NCC), and the Domestic Building Contracts Act 1995 (Vic)
  • Photographic evidence documenting each defect

Do I need to go through DBDRV before VCAT?

In most domestic building disputes, yes. You generally need to apply to the Domestic Building Dispute Resolution Victoria (DBDRV) for conciliation before you can take the matter to VCAT. If conciliation fails and you receive a Certificate of Conciliation, you can then apply to VCAT. Our report can be used at both the DBDRV stage and the VCAT hearing.
